Terms of Service

By creating an account, accessing, or using the QuantumCals Laboratory Information Management System (LIMS) platform ("Service"), you agree to comply with and be legally bound by these Terms of Service ("Terms"). These Terms apply to all users, including organizations, lab administrators, and individual users.

If you do not agree to these Terms, you must not access or use our Service. These Terms constitute a binding legal agreement between you and QuantumCals Technologies Private Limited.

QuantumCals provides a cloud-based Laboratory Information Management System (LIMS) designed for calibration and testing laboratories. The Service includes:

• Job management and calibration tracking modules
• Certificate generation and digital signature functionality
• Customer management and automated reminder systems
• Compliance management for NABL, FDAS, IQAS, and ACCAB accreditations
• Cloud storage with Microsoft 365 integration
• Role-based access control and employee management
• Live dashboards and reporting tools
• API access (where applicable to your subscription)

To use the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security of your account credentials and not share passwords
• Promptly notify us of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account
• Not create accounts for competitive intelligence or benchmarking purposes

Organizations are responsible for managing user accounts within their subscription and ensuring all users comply with these Terms.

QuantumCals operates on a subscription basis. By subscribing, you agree to:

• Pay all fees as described in your selected subscription plan
• Provide valid payment information and keep it current
• Automatic renewal of subscriptions unless cancelled before the renewal date
• Non-refundable fees except as stated in our refund policy

Refund Policy: New subscriptions may be cancelled within 7 days for a full refund. After 7 days, no refunds are issued for the current billing period. Annual plans cancelled after 30 days receive a prorated refund for remaining months minus a 10% processing fee.

Your Data: You retain full ownership of all data you input into QuantumCals, including lab records, customer information, certificates, and calibration data ("Customer Data"). We do not claim ownership of your Customer Data.

License to Us: You grant QuantumCals a limited, non-exclusive license to process, store, and display your Customer Data solely to provide the Service.

Data Export: You may export your Customer Data at any time through the platform's export features. We provide data in standard formats (CSV, Excel, PDF).

No Mining: We will not use your Customer Data for machine learning training, advertising, or any purpose beyond operating the Service without explicit consent.

You agree not to use the Service to:

• Violate any applicable laws, regulations, or industry standards
• Upload false, fraudulent, or misleading calibration data or certificates
• Attempt to gain unauthorized access to our systems or other users' accounts
• Reverse-engineer, decompile, or attempt to extract our source code
• Transmit malware, viruses, or any malicious code
• Use automated tools to scrape or extract data without permission
• Resell or sublicense the Service without written authorization
• Use the platform for any purpose other than legitimate laboratory management

The QuantumCals platform, including all software, interfaces, documentation, and branding, is owned by QuantumCals Technologies and protected by copyright, trademark, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable license to use the Service as described in these Terms. This license does not permit you to copy, modify, distribute, or create derivative works based on our platform.

To the maximum extent permitted by applicable law, QuantumCals shall not be liable for:

• Indirect, incidental, special, consequential, or punitive damages
• Loss of data, profits, revenue, or business opportunities
• Damages resulting from unauthorized access to your account
• Third-party actions or services connected to QuantumCals

Our total liability for any claims under these Terms shall not exceed the amount you paid to QuantumCals in the 12 months preceding the claim.

Either party may terminate the subscription at any time. Upon termination:

• Your access to the Service will end at the end of the current billing period
• You may export your data within 30 days of termination
• After 30 days, Customer Data may be permanently deleted
• Provisions of these Terms that by their nature should survive will remain in effect

We reserve the right to suspend or terminate accounts that violate these Terms immediately and without notice.

These Terms are governed by the laws of India, specifically the Information Technology Act, 2000, and the laws of the State of Gujarat. Any disputes shall be resolved in the courts of Gandhinagar, Gujarat, India.
